Membership Eligibility:

  1. You must be 14 years of age or older and residing in Australia only to become a member in the My Calls Free Program. Corporations, partnerships, or any other business entities are not eligible for membership.
  2. The Program is available via access to the My Calls Free Website: My Calls Free You must have Internet access and a valid email address to be eligible to receive the privileges and benefits of membership. My Calls Free is not responsible for your inability to connect to the Internet, log onto the My Calls Free Website or access your My Calls Free Account.
  3. Members must be human: no machines, scripts, or automated services may be used to accumulate RewardsPoints.
  4. Membership is limited to one Account per person. You cannot maintain multiple accounts even if you have multiple e-mail addresses. Any duplicate accounts will be subject to termination, and any RewardsPoints accumulated therein will be forfeited.
  5. My Calls Free may refuse any application for membership.


Privacy Policy:

  1. My Calls Free recognizes the importance of protecting your privacy. We also recognize that when you choose to provide information about yourself, you trust us to act in a responsible manner. We believe this information should only be used to help us provide our Members with better service. That is why we have put a privacy policy in place that guides how we collect, store and use personal information about our Members. Our online privacy policy can be found at our Website: www.mycallsfree.com.au and we urge you to review our privacy policy before enrolling in the My Calls Free Program as it forms part of the Program Terms and Conditions of this Agreement.


Accrual of Rewards Points:

  1. RewardsPoints is the rewards currency of the My Calls Free Program. As a Member, you will have the opportunity to earn RewardsPoints by purchasing products and/or services offered as Approved Promotions on our Offer Partners Websites from time to time, and/or by participating in questionnaires, surveys or contests. It is your responsibility to comply with the rules specified by each Promotion. Your eligibility to participate in any given Promotion and your compliance with the rules for fulfilment of any given Promotion, will be determined solely by My Calls Free and the Offer Partner sponsoring such Promotion.
  2. In order for our reward points to be credited to your member account in real time, members MUST have their cookies enabled for us to record their actions. My Calls Free accepts no responsibility if at the time of action you did not have your cookies enabled for transactions NOT being recorded.
  3. Prior to participating in any Promotion, you should note the product shipping policy of the Offer Partner sponsoring such Promotion to determine whether the Offer Partner is able to fulfil its obligations to you (i.e., shipping merchandise to your residence).
  4. My Calls Free reserves the right to invalidate RewardsPoints posted to your Account upon notice by the Offer Partner that you did not fulfil your obligation under the applicable Promotion rules. This includes signing up for a My Calls Free offer, survey or competition more than once.
  5. Once you fulfil all applicable requirements for a Promotion, the designated number of RewardsPoints specified by that Promotion will be transferred into your Account. In some cases, there may be some delay in the crediting of RewardsPoints to your Account. For example, delays may be caused by the Offer Partner's failure to forward the proper information to My Calls Free, technical difficulties, or otherwise.
  6. My Calls Free will not be responsible for any delay or failure to credit RewardsPoints to your Account. It is your responsibility to regularly check you're Account to ensure that RewardsPoints transfers have been properly credited and that your Account balance is accurate.
  7. My Calls Free is not responsible for changes to, or discontinuance of any Promotion, Offer Partner withdrawals from the Program, or for any effect on accrual of RewardsPoints caused by such changes, discontinuance, or withdrawal.
  8. My Calls Free is under no obligation to provide Members with a guaranteed number of Reward Points opportunities or advise them of promotional offers.
  9. RewardsPoints earned from certain Offer Partners may not be redeemable for all Rewards. For more information regarding restrictions on RewardsPoints from specific Offer Partners, please refer to the Offer Information pages located at My Calls Free . For additional questions about specific Promotions, please address inquiries to My Calls Free via email to admin@mycallsfree.com.au
  10. All Rewards are subject to promotional availability from our partners providing the goods. We reserve the right to withdraw or vary any offer in any way without prior notice.
  11. A member must claim an award within 12 months from the time the points were initially credited or points will expire and be deducted from the members account balance.


Cookies:

  1. Once you become a My Calls Free member, a cookie is stored in your web browser. Hence, the next time you visit the My Calls Free site your browser will send the cookie to our web server. The purpose of storing a cookie is for us to identify who you are and prepare a customized web page for you. Be assured that your cookie can be accessed across the Internet only by the My Calls Free web site. Furthermore, the use of cookies is widely accepted by the Internet community. Cookies also MUST be in enabled when purchases or actions are being taken in order to earn your reward points. Cookies are used as part of our real time tracking system. If cookies are switched of, we cannot record your transaction in our system.


Spamming:

  1. The Spam Act 2003 (Cth) refers to spam as 'unsolicited commercial electronic messaging'. Electronic messaging covers emails, instant messaging, SMS and other mobile phone messaging. An unsolicited commercial electronic message is considered to be spam if it is sent without the prior consent of the recipient. Thus, when you sign up as a member of My Calls Free, you must explicitly agree to allow us to send you commercial advertising emails. As a rule, commercial electronic messages must contain accurate information about the goods or services advertised, offered or promoted by the sender of the message and an unsubscribe option allowing members to stop receiving messages. My Calls Free complies with these rules. If at any time you receive an unwanted email from My Calls Free or if you have questions about any of the practices outlined in this Privacy Statement, please do not hesitate to contact My Calls Free to resolve the issue.


Partner web sites:

  1. As part of the reward process, My Calls Free provides links to their partner websites. This privacy statement applies specifically to the My Calls Free website. When you visit a partner website they employ a separate Privacy Statement which we are not responsible for. Hence, it is advised that when you visit a partner website you read their privacy statement. My Calls Free are not liable for any content of the partner sites.


Claiming a Reward:

  1. When you register for membership at the My Calls Free Website, you will be asked to enter a user name and password. This will allow you to access your Account to verify transfers, check account balances, and redeem RewardsPoints for selected products and services (the 'Rewards').
  2. You must be logged into the My Calls Free Website, using your email address and password, in order to access your Account. You may check your account status and recent earning history at any time.
  3. My Calls Free is entitled to act on instructions received under your password. For security purposes, it is recommended that you memorize your password, and do not write it down. You are responsible for maintaining the confidentiality of your email address, password, and account information. My Calls Free is not responsible for any credits or debits made to your Account or for any loss you may incur as a result of any unauthorized person using your email, password or account information.   4. Members agree to provide correct and accurate personal identifying information including email address to My Calls Free.
  5. My Calls Free is not responsible for changes to or discontinuance of any product, merchandise or service, or for Offer Partners or Suppliers withdrawal from the Program, or for any effect on or devaluation of Rewards caused by such change, discontinuance, or withdrawal. Members should not rely upon the continued availability of any Reward or award level.
  6. My Calls Free will not be held responsible for late shipping, damaged, incorrect or defective merchandise or returns. Nor will My Calls Free be responsible for missing Rewards or merchandise.
  7. Once the Member redeems RewardsPoints for Rewards, the appropriate number of RewardsPoints will be deducted from the Member's Account. Under no circumstances will Rewards be refunded or exchanged for RewardsPoints or cash. Nor will RewardsPoints be restored to the Member's Account once a Member claims a Reward. All redemptions are final.
  8. RewardsPoints have no cash value and are not redeemable in the event My Calls Free ceases to do business or is sold, assigned, declared bankrupt or a receiver or administrator is put in place.
  9. RewardsPoints cannot be combined or used in conjunction with other promotions, coupons, discounts or special offers, except where designated by My Calls Free.
  10. RewardsPoints are void where prohibited by Australian law.
  11. The number of RewardsPoints redeemable in a given year may be limited. For information regarding specific restrictions, please refer to the Reward Information Pages at My Calls Free
  12. My Calls Free reserves the right to limit the redemption of specific Rewards and limit the number of Rewards available on any particular promotional offer. Additional information regarding restrictions on redemption is provided in the Reward Information Pages and the Offer Information Pages located at the My Calls Free Website: My Calls Free For additional questions regarding specific promotions, please address inquiries to My Calls Free
  13. It is your responsibility to read and understand the information provided on these pages before accumulating RewardsPoints. These pages are frequently updated. Further, it is your responsibility to check these pages regularly to determine whether the restrictions have been modified. If you do not agree to any such modification, you must immediately cease participation in the Program.


Non-Transferability:

  1. RewardsPoints earned, granted or accumulated under the Program may not be assigned or transferred to any third party.
  2. The sale or barter, assignment, or other disposal of any such RewardsPoints is expressly prohibited.
  3. RewardsPoints do not constitute property, and are not transferable:
    1. upon death,
    2. as part of a domestic relations matter, or
    3. otherwise by operation of law.
  4. RewardsPoints assigned, sold, or otherwise transferred in violation of the Program Rules will be confiscated or cancelled. Any violator of the foregoing restrictions is subject to account termination, deduction of RewardsPoints from his or her account, and/or liability for damages and litigation and transaction costs.


Termination:

  1. My Calls Free reserves the right to terminate the Program at any time, for whatever reason with 30 days notice, which notice may be satisfied by a posting on the My Calls Free Website. This means you will have 30 days from the date of notice to accumulate and redeem RewardsPoints in your Account before the Program terminates.
  2. Notification of Program termination will be posted on the My Calls Free Website. My Calls Free will not be held responsible for failing to notify you of Program termination should you fail to check the My Calls Free Website on a regular and frequent basis.
  3. My Calls Free may at any time and without notice suspend or disable the My Calls Free Website for maintenance or upgrades. My Calls Free will not be responsible for Members' inability to redeem or earn My Calls Free for the period that the My Calls Free Website is disabled.
  4. Your continued membership in the Program constitutes your agreement to all such terms, conditions, modifications, updates or notices.


Termination of Membership:

  1. A Member may terminate membership in the Program at any time and is effective upon submitting a termination request via the account area and receiving on page confirmation of termination from My Calls Free. RewardsPoints accumulated but not redeemed by the Member up to the date of termination will be forfeited. Members may not accrue or redeem RewardsPoints after the date of termination.
  2. My Calls Free reserves the right, in its sole discretion, to terminate your membership in the Program at any time, without notice. Upon termination, the Member's right to accrue and redeem RewardsPoints shall immediately be cancelled. Any and all RewardsPoints accumulated but not redeemed up to the date of termination will be forfeited.
  3. Membership in the Program is subject to this Member Agreement, the Offer Information Pages, Reward Information Pages, applicable Offer Partner and Supplier restrictions and the Privacy Policy (collectively, the "Program Terms and Conditions"). Any failure to comply with the Program Terms and Conditions, any fraud or abuse relating to the accrual or redemption of RewardsPoints or any misrepresentation of any information supplied to My Calls Free or its affiliates by you, or anyone acting on your behalf, may result in the termination of your membership in the Program, cancellation of your My Calls Free Account and/or forfeiture of your RewardsPoints.
  4. Membership in the Program terminates immediately upon Member's death; or if Member does not use his or her Membership account for a period of 12 months or more; or Member supplies misleading information or makes any misrepresentation to My Calls Free.
  5. If at any time, you do not accept the Program Terms and Conditions, or any subsequent amendments or modifications thereto, or become dissatisfied with the My Calls Free program; your sole remedy is to terminate your participation and membership in the Program.


Tax:

  1. Any tax, or liability or duty arising from member's participation in the My Calls Free program is the responsibility of the Member.


Notification of Changes:

  1. If we decide to make changes to our Privacy Policy or Member Agreement, we will post those changes on our Website at: My Calls Free so that our Members are always aware of any changes to the Program or any modifications regarding the kind of personal information we collect, how we use it and under what circumstances, if any, we disclose it. Members have a continuing obligation to check our Website on a regular basis for all Notifications and changes to the Program.


Disclaimer of Warranties:

  1. THE MY CALLS FREE PROGRAM IS BEING PROVIDED TO MEMBER "AS IS" WITH NO EXPRESS OR IMPLIED WARRANTY OR CONDITION. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MY CALLS FREE EXCLUDES ALL CONDITIONS, REPRESENTATIONS, WARRANTIES AND OTHER TERMS WHICH MIGHT OTHERWISE BE IMPLIED INTO OR INCORPORATED INTO THIS AGREEMENT, WHETHER BY STATUTE, COMMON LAW OR OTHERWISE, WITH RESPECT TO THE PROGRAM, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES AND TERMS AS TO MERCHANTABILITY, SATISFACTORY QUALITY, N0N-INFRINGEMENT AND FITNESS FOR ANY PARTICULAR PURPOSE AND IMPLIED WARRANTIES AND TERMS ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE.
  2. TO THE EXTENT PERMITTED BY LAW MY CALLS FREE DOES NOT WARRANT, GUARANTEE, OR MAKE ANY REPRESENTATIONS REGARDING THE QUALITY OF, OR ACCURACY OF ADVERTISEMENTS OR PROMOTIONS FOR ANY MERCHANDISE, PRODUCTS, OR SERVICES OFFERED OR PROVIDED BY OFFER PARTNERS OR SUPPLIERS IN CONJUNCTION WITH THE PROGRAM NOR DOES IT ASSUME ANY RESPONSIBILITY FOR INFRINGEMENT OF THIRD PARTY INTELLECTUAL PROPERTY RIGHTS ARISING THEREFROM, OR ANY FRAUD OR OTHER CRIME FACILITAED THEREBY.
  3. IN ADDITION, ALTHOUGH MY CALLS FREE INTENDS TO TAKE REASONABLE STEPS TO PREVENT THE INTRODUCTION OF VIRUSES OR OTHER DESTRUCTIVE MATERIALS TO THE MY CALLS FREE WEBSITE, MY CALLS FREE DOES NOT WARRANT, GUARANTEE OR MAKE ANY REPRESENTATIONS THAT THIS SITE IS FREE OF VIRUSES, TROJAN HORSES, WORMS, TIME BOMBS, CANCELBOTS OR OTHER DESTRUCTIVE MATERIALS. IN ADDITION, MY CALLS FREE DOES NOT WARRANT THAT ACCESS TO THIS SITE WILL BE UNINTERRUPTED OR ERROR-FREE, AND MY CALLS FREE ASSUMES NO RESPONSIBILITY FOR ANY LOSS OR DAMAGE CAUSED BY YOUR ACCESS OR INABILITY TO ACCESS THIS SITE.
  4. YOU ACKNOWLEDGE THAT YOU HAVE NOT RELIED UPON ANY REPRESENTATION, WARRANTY OR OTHER ASSURANCE, WRITTEN OR ORAL, GIVEN OR MADE BY OR ON BEHALF OF MY CALLS FREE PRIOR TO YOU ACCEPTING THE TERMS AND CONDITIONS OF THIS AGREEMENT AND TO THE EXTENT PERMITTED BY LAW YOU WAIVE ALL REMEDIES WHICH, BUT FOR THIS PROVISION, MIGHT OTHERWISE BE AVAILABLE TO YOU IN RESPECT OF SUCH REPRESENTATION, WARRANTY OR OTHER ASSURANCE.


Limitation of Liability:

  1. IN NO EVENT WILL ANY OTHER COMPANY OR PERSON WITH WHICH MY CALLS FREE HAS A CORPORATE PARTNERING RELATIONSHIP, INCLUDING WITHOUT LIMITATION, CO-BRANDING, CO-MARKETING, JOINT DEVELOPMENT, AN OFFER PARTNER RELATIONSHIP, AN AFFILIATE OR A SUPPLIER RELATIONSHIP (EACH A "CORPORATE PARTICIPANT") BE LIABLE TO YOU FOR NON-PERFORMANCE OF MY CALLS FREE' OBLIGATIONS. YOU AGREE NOT TO SUE ANY CORPORATE PARTICIPANT FOR NON-PERFORMANCE BY MY CALLS FREE.
  2. TO THE EXTENT PERMITTED BY LAW, MY CALLS FREE SHALL NOT BE LIABLE FOR ANY DAMAGES, CLAIMS OR LOSSES INCURRED (INCLUDING WITHOUT LIMITATION COMPENSATORY, PECUNIARY, INCIDENTAL, DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES (INCLUDING ANY DAMAGES FOR LOSS OF INCOME OR PROFITS), HOWEVER CAUSED AND WHETHER ARISING BY STATUTE, COMMON LAW OR OTHERWISE IN CONNECTION WITH:
    1. THE PROGRAM;
    2. ANY FAILURE, DELAY, OR DECISION BY MY CALLS FREE IN ADMINISTERING THE PROGRAM, INCLUDING RESPONDING TO CUSTOMER INQUIRIES OR RESOLVING DISPUTES;
    3. THE USE OR INABILITY TO USE THIS WEBSITE OR THE INFORMATION CONTAINED ON THIS SITE; OR
    4. THE PURCHASE OR USE OF ANY MERCHANDISE, PRODUCTS, OR SERVICES OF OFFER PARTNERS OR SUPPLIERS, EVEN IF MY CALLS FREE, OR REPRESENTATIVES THEREOF, ARE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, CLAIMS, OR LOSSES AND NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY.
  3. MY CALLS FREE IS NOT RESPONSIBLE AND ASSUMES NO LIABILITY FOR CHANGES OR DISCONTINUANCES OF SERVICES OR MERCHANDISE FROM SUPPLIERS OR OFFER PARTNERS, WHICH MAY AFFECT PROMOTIONAL OFFERS, OR THE ACCRUAL OF REWARDSPOINTS.
  4. TO THE EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MY CALLS FREE TOTAL LIABILITY, EITHER JOINTLY OR SEVERALLY, TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION RESULTING FROM YOUR USE OF THIS SITE AND/OR PARTICIPATION IN THE PROGRAM, WHETHER IN CONTRACT, TORT (INCLUDING, BUT NOT LIMITED TO NEGLIGENCE) EXCEED ONE AUSTRALIAN DOLLAR (AU$1.00).


Disputes or Errors:

  1. All questions or disputes regarding the Program, including without limitation, questions or disputes regarding eligibility for the Program, or the eligibility of RewardsPoints for accrual or redemption, must be submitted via email within 30 days of the qualifying transaction. My Calls Free shall resolve all and any disputes at its sole discretion. In the event that an error is made by My Calls Free, such error shall not constitute a breach of this Agreement, and your sole remedy shall be the credit of the disputed RewardsPoints to your Account. All interpretations of Program Terms and Conditions shall be at the sole discretion of My Calls Free.


Mediation:

  1. The parties must endeavour to settle any dispute in connection with this Agreement by mediation. Such mediation is to be conducted by a mediator who is independent of the parties and appointed by agreement of the parties or, failing agreement within 7 days of receiving any party's notice of dispute, by a person appointed by My Calls Free. It is a condition precedent to the right of either party to commence arbitration or litigation other than for interlocutory relief, that it has first offered to submit the dispute to mediation.


Jurisdiction:

  1. This Agreement shall be governed by and construed in accordance with the laws of the State of New South Wales, Australia. If any provision of this Agreement is found invalid or unenforceable, that provision shall be enforced to the maximum extent possible, and the other provisions contained herein will remain in full force and effect. My Calls Free' failure to insist upon or enforce strict performance of any provision of the Agreement shall not be construed as a waiver of any provision or right. Nothing in this Agreement shall be construed as creating or constituting a partnership, joint venture or agency relationship between My Calls Free and the Offer Partners, or between My Calls Free and the Suppliers. Neither the Offer Partners nor the Suppliers shall have the ability to create any obligation on My Calls Free' behalf. This Agreement constitutes the entire agreement between you and My Calls Free and supersedes all prior understandings, agreements, communications and / or advertising with respect to the Program.


Indemnification:

  1. Member agrees to indemnify and hold My Calls Free, its affiliates, officers, and employees harmless from any and all claims, demands, damages, and / or costs incurred in connection with any transaction or activity in which you engage in connection with the My Calls Free program that breaches any law, rule or regulation.



Spam:

You may not promote your referral links through unsolicited emailing (i.e. SPAMMING), newsgroup postings, or any other method of mass communication. Failure to comply will result in immediate termination of your membership with My Calls Free and may result in legal prosecution. My Calls Free strictly enforces anti-spamming laws. Spamming is a federal crime. Any member caught spamming will not only have their account terminated immediately and lose any past, present and future earnings, but shall also be held liable for Spamming as we shall cooperate with any authorities and investigations that may arise from the Spamming incident. My Calls Free may charge up to $5 per spam email sent. Multiple signups shall be grounds for immediate termination of all involved accounts. Signing up multiple times from the same computer also constitutes fraud. My Calls Free will file charges for recovery of any earnings received from multiple signups.
